The Council of the Regional Municipality of Ottawa-Carleton met at Haydon Hall, Regional Headquarters, 111 Lisgar Street, Ottawa on Wednesday, 9 September 1998,

at 1:30 p.m.

The meeting was called to order at 1:38 p.m. and opened with the singing of the National Anthem, sung by Amélie Bisaillon from Trillium public elementary school.

The Regional Chair, Robert Chiarelli, presided and lead council in prayer.

CONFIRMATION OF MINUTES

The minutes of the Council meeting of 12 August 1998, were confirmed.

No declaration of interest were filed.

COMMUNICATIONS

  1. Chief Medical Officer of Health, David L. Mowat, Ministry of Health, responding to Dr. Cushman’s 1998/99 Healthy Babies, Healthy Children Budget, informing him that his request has been approved at $621,060. Further details for the funding enhancement in the May budget and allowable expenditure guidelines will be sent to Dr. Cushman in the near future. David Mowat emphasized that they will not approve overspending at settlement time, therefore spending is to be kept within approved amount.

 

2. Association of Municipalities of Ontario (AMO), issuing various communiqués on the following:

- Discussion Paper Released by the Social Housing Committee - Municipalities Encouraged to respond

  1. Ginette Bertrand, Deputy Clerk, Russell Township, informing Council that the Township of Russell, has resolved by resolution number 231-98, on August 4, 1998, to support the request of Cumberland Township for the extension of Frank Kenny Road.

 

 

4. The Honourable Elizabeth Witmer, Minister of Health, responding to Council’s recommendations regarding the public health impacts of casino gambling. She advised that the Ministry of Health is spending $3.5 million in 1998/99 on problem gambling treatment, the toll-free problem gambling helpline, and research and training for problem gambling treatment providers. The government strategy for problem gambling prevention, treatment and research includes the establishment of a centre of excellence for research and prevention of problem gambling. Implementation options for the centre are currently being considered. She also advised that funding for the second counselling position in Ottawa has been approved. Scott MacPherson, the Problem Gambling Consultant of the Bureau, can be contacted at (416) 327-4542 regarding questions.

5. News Release Communiqué (Ontario):

- Province Announces Benefits to Municipal Partners

 

6. The Honourable Tony Clement, Minister of Transportation, responding to Council’s request regarding ministry participation and support for the Joint Technical Committee (TRANS) activities on Transportation planning. The Ministry recognizes the importance of TRANS and is pleased to contribute $9,500, subject to continued participation by the National Capital Commission, the Ministère des Transports du Québec, the Sociètè de Transport de l’Outaouais, and the Regional Municipality of Ottawa-Carleton.

 

7. The Honourable Tony Clement, Minister of Transportation responding to Council regarding Council’s request for the Ministry of Transportation to provide noise attenuation measures in the Nicholas Street Interchange area. The Ministry of Transportation has no requirement to extend the existing noise barriers or to construct any new barriers. The minister says that staff from their Eastern Region Office in Kingston have reviewed this site and discussed the provincial policy with Mr. Brendan Reid of the Project and Infrastructure Planning Branch. In the event that the RMOC, City of Ottawa, or the private sector developers would like to utilize ministry-owned land in the area to construct a berm, they should contact the Ottawa District Office at 530 Tremblay Road to review proposals.

 

 

8. Peter McKenna, Acting Director, Sandy Hill Community Health Centre, thanking the Community Services Committee for supporting enhanced counseling resources for the designated Problem Gambling Treatment Site for the Region. He advised that as of 1 September, 1998, the Ontario Substance Abuse Bureau will provide funding for one and a half new full time counselors. This enhancement combined with a current one position, will mean that the residents of Ottawa-Carleton whose lives are negatively affected by gambling will have two and a half problem counselors to utilize.

That the condition for interim approval approved by Council on 24 June 1998 relating to MetroNet Communication Inc. being permitted to install but not use plant pending negotiation of a Municipal Access Agreement be rescinded, and that the time frame for the expiration of the interim approval authority related to MetroNet Communications Inc. be extended from 15 November 1998 to 12 months from the date of Council approval of this report.

4. CAPITAL GRANT REQUESTS -

VILLA MARCONI LONG TERM CARE CENTRE AND

HILLEL LODGE LONG TERM CARE CENTRE

COMMITTEE RECOMMENDATIONS AS AMENDED

That Council approve:

    1. A request from Villa Marconi to maintain the Region’s funding commitment of $1,014,000 to the Villa Marconi Long Term Care Centre;

    1. A capital grant request in the amount of $1,621,590 from Hillel Lodge for the construction of a new 100-bed Long Term Care Centre;

3. WHEREAS Provincial legislation will no longer allow the Region to collect development charges for the RMOC Health Care Facilities Reserve Fund and therefore this fund has a limited life; and

WHEREAS there will be numerous requests for support from this fund as hospitals, community health centres, long-term care facilities and others try to put in place the services needed to cope with the dramatically-shrunken acute care hospital sector;

BE IT RESOLVED that all further applications to this Fund be held in abeyance until the Regional Chair’s task force on health care has had an opportunity to present Council with a policy framework on how the limited resources in the Health Care Facilities Reserve Fund can best be used to deal with changes to Ottawa-Carleton’s health care system.

TRANSPORATION COMMITTEE REPORT NO. 17

1. Island Park Drive, Kirkwood, Churchill AREA Traffic Calming Pilot Study - PUBLIC HEARING

COMMITTEE RECOMMENDATIONS AS AMENDED

Having held a public hearing, that Council approve:

1. the construction of traffic calming measures for Kirkwood Avenue, Churchill Avenue, Scott Street and Merivale Road identified in Annex A;

2. that all proposed standard speed humps in the proposed pilot projects be replaced by flat top speed humps;

3. that the intersection narrowings at bus stops be extended to provide a flat curb area for all passengers exiting the buses;

4. that, pending consultation with the immediate residents, the flat top speed hump on Kirkwood at Clare be relocated so that any buses traveling in the vicinity of this area will negotiate the hump perpendicularly.

WHEREAS the Ottawa Fire Services has expressed concern about the number of speed humps on Lyon Street and Kirkwood Avenue, because they delay response times, cause mechanical damage to vehicles and personal injury to firefighters; and

WHEREAS the Ottawa-Carleton Regional Ambulance Service has concerns about the speed humps on Lyon Street on Kirkwood because they will have an adverse effect on response times, damage ambulances and pose the possibility of personal and third party injury; and

WHEREAS the Regional Police Service has concerns with vertical measures on Kirkwood Avenue because of public safety; and

WHEREAS the Regional Transportation Department does not support vertical measures such as speed humps on major arterials and have not had an opportunity to explore the impact of speed humps on primary response routes; and

WHEREAS public consultation to date has resulted in an unprecedented response with the overwhelming majority of residents of the affected area protesting these measures, and both the Somerset Heights BIA and the Westboro BIA opposed to traffic-calming;

BE IT RESOLVED THAT Vertical Traffic Calming Measures on Kirkwood and Lyon Street be deferred until the Department has worked with emergency services to review the potential impact on primary response routes, reporting back in the spring of 1999.

Having held a public hearing, that Council approve:

1. the installation of a traffic control signal at the following two intersections in conjunction with the proposed roadway modifications for each intersection;

a. Albion Road (Regional Road 25) and Rideau Road; and;

b. Trim Road (Regional Road 57) and Watters Road;

2. the roadway modifications for the above two intersections as shown in Annex F (pages 2-4) and Annex G (pages 2-3).

4. MARCH ROAD (REGIONAL ROAD 49) AT THE ACCESS TO THE GATEWAY MALL - PROPOSED NORTHBOUND LEFT-TURN LANE AND ACCESS TO 365 MARCH ROAD - PUBLIC HEARING

Having held a public hearing, that Council approve the modifications to the traffic control signals at March Road and Gateway Mall and the construction of associated changes to the roadway along March Road as described in the report and illustrated in Annex C, subject to the owner of 151516 Canada Incorporated:

a) funding the total cost of the traffic signal modifications and the proposed road works;

b) executing a legal agreement with respect to the above.

5. PROPOSED INTERSECTION MODIFICATIONS TO KIRKWOOD AVENUE AND HAMPTON PARK PLAZA/SWITZER AVENUE - HAMPTON PARK PLAZA REDEVELOPMENT - PUBLIC HEARING

COMMITTEE RECOMMENDATION

Having held a public hearing, that Council approve the modifications to the traffic control signals at Kirkwood Avenue and Hampton Park Plaza/Switzer Avenue and the construction of associated changes to the roadway along Kirkwood Avenue as described in the report and illustrated in Annex C, subject to the owners, London Life Insurance Company and Devan Properties Limited:

a) funding the total cost of the traffic signal modifications and the proposed road works;

b) executing a legal agreement with respect to the above.

6. Fallowfield road from woodroffe Avenue to a point 155 m west of woodroffe avenue - Proposed median - PUBLIC HEARING

COMMITTEE RECOMMENDATIONS

Having held a public hearing, that Council approve the construction of a median on Fallowfield Road between Woodroffe Avenue and a point 155 m west of Woodroffe Avenue as illustrated in Annex B, subject to the RMOC and the Long Farm Developments Incorporated:

a) each participating to the extent of 50% in the funding of the median construction costs limited to a maximum Regional contribution of $40,000;

b) executing a legal agreement with respect to the above;

c) the encumbrance of funds in the amount of $40,000 from the Safety Improvement Programme (91-30708).

TRANSPORTATION COMMITTEE REPORT NO. 18

1. LIGHT RAIL PILOT PROJECT: RECOMMENDATIONS AND FEASIBILITY ANALYSIS

COMMITTEE RECOMMENDATIONS

That Council approve:

1. The selection of the Canadian Pacific Railway Ellwood Subdivision, from the West Transitway at Bayview to the Southeast Transitway at Greenboro as shown in Annex C, as the preferred route for a light rail pilot project using diesel-powered low-floor light rail vehicles;

2. Timely examination of possible light rail extensions that are not identified in the Official Plan and Transportation Master Plan (e.g., to Barrhaven, downtown Hull, downtown Ottawa, Ottawa Macdonald-Cartier International Airport), recognizing that it is essential to increase ridership from the suburban communities to Public Transit which presently have lower than average ridership, so that they may be implemented, if and when they are warranted, subject to availability of funds as well as Official Plan amendment and Environmental Assessment approvals;

3. The negotiation with Canadian Pacific Railway and/or appropriate partners, for approval by Council, of a public-private partnership agreement for light rail pilot project implementation and operation, based on the principles contained in Annex D, with capital costs not exceeding a present value of $16 million, and with annual operating costs not exceeding system-wide average operating costs for equivalent ridership levels;

4. The Light Rail Pilot Project Environmental Assessment Terms of Reference, issued separately as Annex F and as modified by a supplemental Annex G (to be issued separately if required), to be submitted to the Ontario Ministry of the Environment for approval;

5. That the pilot project be limited to a maximum of two (2) years.

RESOLVED THAT with reference to recommendation 5 of Transportation Committee Report No. 18, should there be a need to extend the pilot project beyond the 2 year period, that the matter be referred back to Council and that the contract so reflect. The contract provide that should Council decide to extend the project beyond the 2 year period, CP should be required to extend on the same terms.

By-law 69 of 1998 to authorize the levy of sums required for the repayment of debenture number 98-8 issued in the amount of $20,000.00 to aid in the construction of tile drainage works in The Corporation of the Township of West Carleton.

By-law 70 of 1998 to approve area municipality by-laws regulating traffic on local streets as follows:

City of Gloucester 157 of 1998

City of Gloucester 225 of 1997

By-law 71 of 1998 to amend Part 4.1 of the Regional Regulatory Code relating to Water System Charges, Part 5.2 relating to Sewer System Charges, Part 5.3 relating to Solid Waste Rate changes and Part 5.6 relating to Solid Waste Management

MOTION NO. 225

WHEREAS the City of Ottawa has initiated a process for the residential, commercial, and other development of Lansdowne Park in order to avoid operating the facility at a financial loss;

WHEREAS planning related issues must eventually be approved by Regional Council;

WHEREAS Lansdowne Park is of broad importance economically, historically, and socially to residents across the Regional Municipality of Ottawa-Carleton;

WHEREAS the community associations most directly affected, such as the Glebe and Ottawa South Community Associations, have expressed serious concerns about the redevelopment of Lansdowne Park into private homes;

WHEREAS members of the community at large, including the public advisory group set up by the City of Ottawa as part of the current process, have stated that their input was restricted to choosing between two limited alternatives;

WHEREAS there is growing public sentiment that options for maintaining and improving Lansdowne Park as a public facility on a break-even basis, without continuing taxpayer support, have not been fully explored;

WHEREAS designating or removing a Major Community Facilities designation in the Official Plan is often controversial and may only be contemplated after extensive community consultation within the Official Planning Process in which RMOC is legally required to become involved;

WHEREAS the RMOC is required to respond to Official Plan amendments within 90 days of application and therefore advance preparation is required;

BE IT RESOLVED THAT all efforts be made by RMOC to engage the City of Ottawa in cooperation and in partnership to resolve the future of Lansdowne Park;

BE IT RESOLVED THAT staff be directed to begin preparing detailed information on the community and economic impact of the loss of Lansdowne Park for consideration during deliberation surrounding the Official Plan amendment process;

BE IT RESOLVED THAT a working group be formed including members of Council, staff, residents of the surrounding neighbourhoods, community organizations and businesses to begin consultations aimed at examining and report to Council on alternatives which would preserve Lansdowne Park as a public space without ongoing financial support from the City of Ottawa;

BE IT RESOLVED THAT the CAO and Regional Chair be directed to investigate the legal structures by which Lansdowne Park might be placed under community governance through the creation of an independent Lansdowne Park Community Authority operating as a public trust on a break-even basis. The Community Authority would reinvest all revenues into the enhancement and operation of Lansdowne Park as a public place;

BE IT RESOLVED THAT the CAO report to Council on the potential financial exposure the Region might choose to assume if called upon to underwrite the operation of a Lansdowne Park Community Authority either alone or in partnership with the City of Ottawa.

WHEREAS Megaweek legislation changed the terms of reference on which both Ontario school boards and municipalities operate;

WHEREAS under Bill 160, the funding of local school boards is now controlled by the province;

WHEREAS municipalities find themselves with new discretionary powers to decide if new residential development should proceed or not proceed based on the adequate provision and distribution of educational facilities; and

WHEREAS Megaweek changes have resulted in a reduction of funding for many school boards and more responsibilities without an increase in tax revenues for municipalities, i.e., downloading;

BE IT RESOLVED that Regional Council of the Regional Municipality of Ottawa-Carleton approve the creation of a regional-school board task force comprised of 4 Regional Councillors and 4 school trustees from interested Boards to meet to develop ways in which the region and the school boards can co-operatively tackle some of the pressures they are jointly facing;

BE IT FURTHER RESOLVED that areas of co-operation be focused on 5 issues:

1. OC Transpo and school transportation.

2. Health and social services.

3. Usage of school space

4. Joint delivery of services, for example, adult education.

5. Political advocacy: ways the Region can assist school boards to lobby the Province of Ontario on behalf of children at risk, inner-city schools, and the marketing of Ottawa as a high-quality, child-friendly city, such that provincial education policies reflect this Regional need.

BE IT FURTHER RESOLVED that staff resources be made available to the Joint Task Force to undertake the research required.

WHEREAS the Canadian Radio and Telecommunications Commission is holding public hearings on future television broadcasting policy; and

WHEREAS numerous parties have provided input, including the municipalities of London, Windsor and Quebec City; and

WHEREAS the need to keep citizens informed about local issues and the importance of having a local perspective on television is becoming more important in an era of increasingly global communications; and

WHEREAS it is in the interest of a healthy local democracy for community groups, civic officials, business leaders and others to be able to have access to their community, and vice versa, through television; and

THEREFORE BE IT RESOLVED THAT Ottawa-Carleton Regional Council calls on the CRTC to defend and enhance local and regional television programming as a priority in its review of Canadian television policy.
